    Selling a property under power of attorney

    Has anyone done this?
    My parents gave me POA many years ago, when they were both fit and healthy
    In recent years this has been so useful. I took over mum's banking when she found it hard to, and I pay all her care home fees on her behalf.

    It should entitle me to sell her property on her behalf which I need to do soon to continue to pay the care home fees.

    I need to ask someone, but I just wondered if anyone here has experience?

      I'd check with your solicitor Gem before you do anything else. At least they'll be able to guide you through any loopholes. Good luck! x

        I have looked it up Plant and it seems I may have to register it as mum lacks capacity to sell or decide to sell.
        WG, yes we have decided to phone mums solicitors tomorrow and take it from there.

          Gem, I had P of A for my mum and sold her property. It was a long time ago but as far as I can remember there were no problems. P also,had P of A for his Dad and did the same.

              Gem, I've just checked with OH and he says that as long as your P of A was registered with the court there should be no problems. I'm sure your solicitor would be able to confirm this.

              There were no legal problems when I sold my cousin's house last year as the Administrator of his estate - it's not quite the same, but the property sale didn't present any problems, and hopefully it will be the same for you selling your mum's property.

                Thanks everyone.
                The POA gives me full control of finances and property, so as Daisy says, as long as it is registered it should be OK. As it was handled properly through solicitors, with witnesses etc, I can't see that it wouldn't have been registered. Hopefully the solicitor can reassure us.

                    I hope everything goes smoothly, Gem. There's a frenzy of property buying in our area, and properties are selling within days, so I hope it's the same for you with your mum's house. Out of interest, I've just looked on RightMove and in our village there are a couple of houses in the £1.5m to £3.5m bracket and one/two bed retirement flats - all hideously expensive. York is also very desirable and I hope you have buyers hammering on the door to buy. xx

                      I expect we will get around £200 thousand considering the work which needs doing.
